Impact Absorbent Technologies, Inc. (“Impact”), warrants that this product will be free from defects in materials and workmanship for a period of 12 months from the date of purchase by you (the “Warranty Period”), if the product is used, stored and shipped in accordance with the manufacturer’s instructions. With respect to any product found by you to be defective, Impact will, during the Warranty Period and at its sole option,
- promptly repair the defective product without charge or expense to you,
- grant to consumer a refund for such defective product equal to the price paid by you, or
- provide you with a replacement product.
To obtain warranty service under this warranty, you should return the product, shipping prepaid, to Impact at the address shown below. Please contact Impact for a Return Merchandise Authorization. When returning the product, please include your name, address, Returrn Merchandise Authorization, a check or money order in the amount of return shipping and handling, a description of the defect and indicate the date the product was purchased. In no event shall Impact accept return of any products contaminated with hazardous, toxic or caustic chemicals. You are responsible for disposing of such products in compliance with local, state and federal regulations.
In no event will Impact be liable under this warranty for any failure of any product due to improper use, storage or shipment, any misuse or neglect, any attempt to modify the product, or any accident, fire or other hazard. Any product that is repaired or replaced under this warranty shall be warranted for either 90 days or the remainder of the applicable Warranty Period.
This warranty is limited to the original retail purchaser and is not transferable. This is the Impact warranty and it may not be changed or amended by any person, agency, distributor, dealer, or company without prior written authority from Impact.
This warranty is being made in place of all other warranties, express or implied, including without limitation implied warranties of merchantability and fitness for a particular purpose. Impact is not liable for incidental or consequential damages of any nature. These limitations do not apply to residents of those states that do not permit the disclaimer of warranties or the limitation of incidental or consequential damages (including without limitation loss of time, inconvenience or loss of use caused by the product). This warranty gives you specific legal rights, and you may also have other legal rights which vary from state to state.
